How Severe is Your Driver's License Suspension

We have helped countless people facing what some think to be hopeless driver's license suspensions problems. Our knowledge of the rules, regulations and laws governing driver's licensing matters, and our related experience in defending serious traffic citations and traffic violations, puts us in a position to help a driver who is suspended or at risk of having his or her driver's license suspended, revoked or recalled.

Every license suspension case must be carefully examined for possible solutions. Often, the course of action depends on the age of the citation and where you are in the process:

  • Ignored citations over three years old: Many traffic citations causing indefinite suspension of driving privilege can be dismissed as beyond the period of limitation for action on traffic violations. If no disposition has occurred on a citation within three years of issuance, we can seek the dismissal of the citation. Don't simply pay a citation to end it — payment is a guilty plea, and for certain offenses, can lead to automatic additional suspension time.
  • Recent traffic citations — Traffic violations less than three years old can be responded to by pleading not guilty, requesting a hearing before the magistrate, and arguing on the merits to get the charges reduced or dismissed. A dismissal of the citation can save you from any related suspension time, or an amended charge can have a reduced suspension or no loss of driver's license associated with it.
  • Citations that have already been heard: If you plead guilty to a citation that carries a related driver's license suspension, we may be able to go back and reopen the case. Prompt action is required because there are appeal deadlines. However, even where the time to appeal a traffic violation has expired, we can request that the Court restore your appeal rights and then proceed to challenge the citation and remove the suspension time.
  • Credit for suspension time: The attorneys at our firm can respond to situations where you have been under suspension for a lengthy period of time, and thought you were serving the suspension — only to find out that PennDOT is claiming you are not entitled to credit. We can prepare and petition for a credit hearing and sometimes obtain a temporary restoration of your driving privilege while the credit hearing is pending, known as a "supersedeas". This process is especially helpful to out of state residents who have old license suspension problems in Pennsylvania that because of the NDR (National Driver Registry) prevent them from getting a license in the state they now live in.
  • Correction of records: Some driving records are simply incorrect. A person with a DUI may have completed his treatment and prison time but is under suspension because PennDOT was not notified. We can help.
  • Judgments: Judgments from a vehicle accident can lead to indefinite suspension. We can assist in resolving the judgment and thereby eliminate the suspension of your driver's license.
