Pennsylvania Expungement Law

Currently, as a general rule, persons with a criminal convictions in Pennsylvania are NOT eligible to have their arrest history expunged. Exceptions exist in very limited circumstances, such as when:

  • A person is 70 years of age and has been free of arrest or prosecution for at least 10 years
  • Information on a person who has been deceased for more than 3 years can be expunged

Thus, people with even minor misdemeanor convictions could generally NOT have their record expunged. However, proposed legislation may change that. A current bill in legislature proposes to allow expungement of certain misdemeanors if the individual has not had an arrest or prosecution for at least 7 years after conviction.
